Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Falcoscan (“Falcoscan”, “we”, “us”) covering falcoscan.com and every related page, feature, report, email and service we provide (the “Service”). By using the Service, creating an account, or making a purchase, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

You must be at least 18 years old, or the age of majority where you live, to create an account or buy anything. If you use the Service for an organization, you confirm you are authorized to accept these Terms on its behalf, and “you” includes that organization.

Falcoscan is a market intelligence service that tracks AI tools and markets and publishes scores such as Heat, Opportunity and Saturation, along with editorial research, reports and newsletters. We may add, change or remove features at any time. If a change materially reduces what a paid plan includes during a period you have already paid for, we will tell you and, where appropriate, offer a prorated refund for that change.

Everything on Falcoscan, including scores, rankings, reports, briefs, monitoring updates and newsletters, is general information for research and educational purposes. Nothing on the Service is financial, investment, legal, tax or other professional advice, and nothing is a recommendation to buy, sell, build, invest in or avoid any company, product or market.

Scores are produced by the methodology described on our methodology page and reflect analysis of public information. They are opinions about markets, not statements of fact about any company. You are responsible for your own decisions. Do your own research and consult qualified professionals before acting on anything you read here.

We work hard to keep our data accurate and current, and we show sources and freshness dates where we can. Market data, company details, pricing and scores come from public sources, third parties and our own analysis, and may contain delays, errors or omissions. We don’t guarantee that any information is complete, accurate, current or fit for a particular purpose.

If you spot something wrong about a tool you represent, tell us at friends@falcoscan.com. We may correct, update or remove content at any time, at our discretion.

You’re responsible for the information you give us, for keeping your sign-in details secure, and for everything that happens under your account. Accounts are for one person. Don’t share your login or let others use a plan beyond its seat limit. Tell us promptly if you think your account has been compromised.

Prices. Current plan prices are shown on our pricing page once you’re signed in, and always at checkout before you pay. Prices are in US dollars and don’t include taxes unless stated. You are responsible for any sales, use, VAT or similar taxes that apply to your purchase.

Free trial. New accounts get 7 days of access to paid-plan features, including the Market Terminal, without a payment method. When the trial ends, those features stop unless you choose a paid plan, and nothing is charged automatically. If you subscribe during the trial, billing starts when the trial ends. We may change or end the trial offer for new accounts, and we may limit trials to one per person.

Payment. Payments are processed by Stripe. By purchasing, you authorize us, through Stripe, to charge your chosen payment method for the price shown at checkout, plus any applicable taxes. We never see or store your full card number.

Automatic renewal. Subscriptions (Pro, Studio, Team and Partner monitoring) renew automatically at the end of each monthly or annual billing period, and you will be charged the then-current price for your plan until you cancel. You can cancel at any time from your account’s billing page.

Price changes. If we change the price of your plan, we will tell you at least 30 days before it takes effect. The new price applies from your next renewal. If you don’t want to continue, cancel before then.

Plan changes. Upgrades and downgrades are handled through the billing portal. Stripe may apply prorated charges or credits when you switch plans mid-period.

Failed payments. If a renewal payment fails, we may retry the charge and may suspend paid features until the balance is paid.

Features marked “Rolling out.” Some plan features are labeled “Rolling out” on our pricing page. They are planned but not yet available, and we don’t guarantee when they will ship or exactly how they will work. Please buy a plan based on what is available today, not on features that are rolling out.

Subscriptions. You can cancel anytime. Your plan stays active until the end of the billing period you have already paid for, and then it won’t renew. Payments are non-refundable, and we don’t give refunds or credits for partial periods or unused time, except where the law requires it or where these Terms say otherwise.

Reports. Competitive Entry Briefs and other reports are prepared by hand. If you cancel before we have confirmed the scope with you, or if we can’t deliver your report, we will refund you in full. Once we have confirmed the scope and started work, the fee is non-refundable.

Featured partner listings. If we decline your partner application or don’t publish your paid listing, we will refund the listing fee in full. Once your listing is published, the fee is non-refundable.

Disputes. If you think you were charged in error, contact us at friends@falcoscan.com before disputing the charge with your bank, and we will work to fix it. We may suspend accounts with open payment disputes. We may also offer refunds or credits at our discretion; doing so once doesn’t oblige us to do so again.

Partner program. AI tool makers can apply to become Falcoscan partners. We review every application and may decline one for any reason, including if we can’t verify the company or product. An approved partner can buy a Featured partner listing: a profile on our Partners page, labeled “Featured partner,” built from the information you give us. You confirm that information is accurate and that you may share it, and you let us display your company name, logo and product description on the Service. We may edit a listing for accuracy, length or clarity, and we may remove a listing that turns out to be inaccurate, misleading or in breach of these Terms. A listing, like any payment, never changes a tool’s scores, rank or inclusion (see Editorial independence below).

Reports, briefs and monitoring updates are research based on public information and our methodology. They describe markets as we see them at the time and do not guarantee any business result. Delivery times we give are estimates.

You may use a report you buy for your own internal business purposes, including sharing it within your organization or, for Competitive Entry Briefs, with the client it was prepared for. You may not resell it or publish it in full. You grant us permission to use the information you give us (such as your tool’s website and the questions you want covered) to prepare the report. We keep reports private to you, and we may use aggregated, de-identified learnings to improve the Service.

No payment of any kind changes a tool’s scores, rank, confidence rating, or whether it is included on Falcoscan. Buying a report, plan, verified profile or any other product gives you no right to change our editorial content, scores or methodology. Any paid placement will be clearly labeled, as described in our sponsorship policy.

If you submit a tool, claim a profile, or send us information, logos, screenshots or other material, you confirm that you have the right to share it and that it is accurate and not misleading. You give us a worldwide, royalty-free, non-exclusive license to host, display, adapt and publish that material as part of the Service. We may edit, decline or remove any submission, and a submission doesn’t guarantee a listing or any particular score.

The Service and its content, including text, graphics, logos, data compilations, scores, scoring methodologies and software, belong to Falcoscan or its licensors and are protected by intellectual property laws. The Falcoscan name and logo are our trademarks.

Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use or, on a paid plan, for your internal business purposes. You may quote small amounts of our public content with attribution and a link to Falcoscan. Any other reproduction, redistribution, commercial use or bulk use needs our written permission, for example through a data pilot.

You agree not to:

• Use bots, scrapers or other automated means to collect, harvest or extract data from the Service without our written permission.
• Resell, redistribute, sublicense or commercially exploit our data or content, or use it to build a competing product or dataset.
• Use our data or content to train or fine-tune machine learning models without our written permission.
• Get around usage limits, seat limits, paywalls or security measures, or share paid access with others.
• Interfere with, disrupt or attempt to gain unauthorized access to the Service or its systems, or reverse engineer it except where the law allows.
• Impersonate anyone, misrepresent a connection with Falcoscan, or submit false or misleading information.
• Use the Service for anything unlawful, harmful or fraudulent.

The Service links to third-party websites and relies on third-party providers, such as Stripe for payments. We aren’t responsible for third-party websites, products or services, and your use of them is governed by their own terms and policies. A listing on Falcoscan isn’t an endorsement of any tool.

The Service and all content, scores, reports and services are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, title and non-infringement. We don’t warrant that the Service will be uninterrupted, secure or error-free, or that any information is complete or accurate. Some jurisdictions don’t allow certain disclaimers, so some of these may not apply to you.

To the fullest extent the law allows, Falcoscan will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, opportunity, data or goodwill, arising from or related to the Service or these Terms, even if we were told such damages were possible.

Our total liability for all claims arising from or related to the Service or these Terms is limited to the greater of (a) the amount you paid Falcoscan in the 12 months before the event giving rise to the claim, or (b) US$100. These limits apply to every theory of liability and even if a remedy fails of its essential purpose. They don’t limit liability that can’t be limited by law.

You agree to defend, indemnify and hold harmless Falcoscan and its owners, contractors and agents from any claims, losses, liabilities and expenses, including reasonable legal fees, arising from your misuse of the Service, your breach of these Terms, content you submit, or your violation of any law or third-party right.

You can stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us, or if we stop offering the Service. If we terminate a paid plan without cause, we will refund the unused part of any prepaid period. Sections that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, limitation of liability, indemnification and governing law, will survive.

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Before filing any claim, you agree to contact us at friends@falcoscan.com and try to resolve the dispute informally for at least 30 days.

Any dispute that isn’t resolved informally will be brought exclusively in the state or federal courts located in Travis County, Texas, and both parties consent to their jurisdiction. Either party may bring an individual claim in small claims court. To the extent the law allows, claims must be brought individually and not as part of a class or representative action. Nothing here limits rights you have under the consumer protection laws of the place where you live.

We may update these Terms from time to time. We will post the new version here with a new “last updated” date, and for material changes we will give reasonable notice, such as by email or on the Service, before they take effect. Continuing to use the Service after changes take effect means you accept them. If you don’t agree, stop using the Service and cancel any subscription.

These Terms, together with our Privacy Policy and any terms shown at checkout, are the entire agreement between you and Falcoscan about the Service. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn’t a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. We aren’t liable for delays or failures caused by events beyond our reasonable control.
